  • Following a tentative order overruling a demurrer and oral argument, successfully convinced the Court that the plaintiff in a toxic tort matter failed to identify the specific products allegedly supplied by the client. Although the plaintiff was granted leave to amend, they failed to do so within the court-ordered timeframe. The client’s subsequent motion to dismiss was granted as a result.
  • Obtained voluntary dismissal of clients in a multi-party toxic tort case following protracted conferrals with plaintiff prior to filing the clients’ responsive pleadings.
  • Successfully argued on behalf of insurance adjuster in a breach of contract and bad faith matter that the plaintiff did not rely on the adjuster’s statements, and contended that the adjuster, as an employee of the insurance company, could not conspire with their employer, resulting in a sustained demurrer without leave to amend.
  • Through early and extensive investigation, obtained voluntary dismissal on behalf of contractor client in multi-party construction defect and personal injury case by convincing the plaintiff that the client’s involvement in the construction of the property did not occur until after the incident in question.
