Walsworth prevailed on demurrer without leave to amend on behalf of the firm’s property owner and property manager clients in a case involving personal injuries stemming from an alleged fall on a stairway that plaintiff claimed was defectively constructed and/or maintained at the property. The demurrer involved the creative use of a request for judicial notice to demonstrate that the statute of limitations had expired prior to the filing of the complaint.
The defense was represented by Jennifer Morin and Sadaf Nejat of the Orange office.
