Nicholas Lunsford is a senior associate at Walsworth who focuses his practice on asbestos and general liability matters. - Obtained summary judgment in a wrongful death action by successfully convincing the Court that there was a lack of liability through interpretation and construction of indemnity provisions. Plaintiffs alleged causal connection between the incident and the City and County of San Francisco, which was defeated under principles of the Privette Thus, plaintiffs were unable to demonstrate a meaningful degree of connection between the owner of the project and the general contractor.
- Assisted a complete defense ruling on a personal injury matter where plaintiff alleged deafness resulting from a high school rally. The decision resulted from rigorous expert depositions and motions in limine to exclude prejudicial and irrelevant expert evidence pertaining to a “test / simulation” that failed to accurately replicate the circumstances purportedly causing plaintiff’s injuries.
- Argued various discovery motions, including motions to compel, before the Court and procured sanctions as well as further responsive discovery. These motions have been triumphant in matters regarding landlord-tenant disputes and construction defect matters. Said victories led to production of highly pertinent documents and information that facilitated favorable resolutions at mediation.
