- Obtained a dismissal for a client facing a $1,000,000 demand in a matter where Plaintiff, a rideshare driver, was injured in a motor vehicle accident involving multiple cars. Emily was able to establish through fact discovery that her client did not cause or contribute to the subject accident.
- Obtained a dismissal of a manufacturer client in a pending mesothelioma case where Plaintiff alleged he was exposed to asbestos from client’s equipment during his career working at powerplants. Through fact discovery, it was proven Emily’s client did not have asbestos-containing equipment at the subject exposure site.
- Prevailed on summary judgment in a wrongful death mesothelioma matter where the Plaintiffs claimed that the client allegedly supplied asbestos-containing materials to which the Decedent was exposed while he performed shipboard work. The Court agreed that Plaintiffs’ witnesses could not establish that client supplied materials to which Decedent was exposed.
- Successfully obtained summary judgment in a personal injury mesothelioma matter through argument that Plaintiff’s witnesses could not establish that Walsworth’s client supplied asbestos-containing industrial equipment that Plaintiff worked with and around during his career.
