Brian Frary is a partner at Walsworth who focuses his practice on employment law matters. He is an accomplished trial attorney with more than 30 years of experience in all aspects of civil litigation, including developing case strategy, forming discovery plans, taking and defending depositions, and representing clients in arbitrations, mediations, and trial. 

Prior to joining Walsworth, Brian defended a wide range of clients in matters involving business litigation, employment litigation, consumer finance litigation (including defense of FDCPA, TCPA, and GLBA cases), class actions, PAGA actions, real estate, products liability, personal injury, construction defects, and professional liability. He also has a decade of experience serving as corporate counsel and managing global litigation for several publicly traded corporations.

Brian utilizes an efficient and streamlined approach to litigation, while focusing on the needs and litigation goals of his clients. He works closely with his clients to craft a litigation strategy that offers the best chance for a successful outcome.

  • Defended a homeowner in a real estate non-disclosure case, where the alleged damages exceeded $4 million and the defendant real estate professionals settled out of the case on the eve of trial. Following a bench trial, the Court awarded damages to the plaintiff in an amount less than the amount paid by other defendants in settlement. Pursuant to the terms of the Real Estate Purchase Agreement, the homeowner defendant was deemed to be the prevailing party for purposes of recovering attorney’s fees, expert fees, and costs.
  • Successfully litigated numerous Employment Class Action and PAGA cases in California, including cases with more than 1,000 Class or PAGA members.
