Walsworth employment partner, Sage Knauft, spoke to Society For Human Resource Management in an in-depth discussion into the constantly changing landscape of state laws regarding the types of criminal records eligible for sealing or expungement. Knauft advises on the trends HR professionals should be aware of in these legislative efforts and ways to protect companies from liability in this area.
Knauft explains, “Legislative efforts have been two-fold: on the criminal side, to expand the types of offenses subject to sealing and expungement, and on the HR side, the ban-the-box ordinances.” As a result, he suggests that the most important step that HR professionals can make is to keep up with all relevant laws.
