  • Plaintiff v. Automobile Parts Manufacturer – Obtained summary judgment in favor of an automobile parts manufacturer in an asbestos-related mesothelioma case. The court agreed with our argument that the plaintiff’s factually devoid discovery responses and deposition testimony confirming that he had never heard of our client and had no evidence to support his allegations shifted the burden to plaintiff to establish the existence of a triable issue of fact. Because plaintiff could not meet his burden to present any admissible evidence of a material fact warranting trial, the court disposed of the matter in favor of the defense.
  • Secured a pre-trial dismissal for a contractor in a wrongful death mesothelioma case filed in San Francisco Superior Court. Plaintiffs alleged that their decedent was exposed to asbestos by numerous defendants, including our client, when working as an insulator. Plaintiffs’ counsel provided the dismissal after being served a dismissal letter that demonstrated there was insufficient evidence to support the claims against our client.
